Claim Types

The majority of dental negligence claim types are explained below.

Claims as a result of mistakes and errors by dentists and dental technicians can occur during bleaching, the fitting of cosmetic veneers, crowns, bridges and in other types of orthodontics which can all be pursued on a No Win No Fee basis by our team.

A missing tooth can be both unattractive and a common solution is to use a dental implant which is a specialist area of treatment, which can lead to complications such as dental implants being fitted incorrectly leading to painful and expensive remedial treatment. Our team are at hand to assist in claiming compensation to seek recompense for this treatment.

Periodontal Disease is a condition which affects the gums and it can progress to permanently destroy the bone that supports teeth.

Undiagnosed Gum Disease

Some dentists fail to diagnose Periodontal Disease or only diagnose it at a very late stage, by which time serious damage may have already taken place such as the teeth becoming loose and eventually having to be extracted.

It is important that Periodontal Disease is diagnosed and treated as early as possible to minimise the damage caused. Therefore, it is important that your dentist when treating the patient is always looking out for the signs of Periodontal Disease. Some dentists fail to diagnose Periodontal Disease or diagnose it at a very late stage, by which time the serious damage will have already taken place.

If Periodontal Disease is diagnosed for a patient it is important that the patient receives the appropriate treatment and be carefully monitored so that the treatment can be changed if it is not controlling the disease. In some cases, referral for specialist treatment may be required. Unfortunately, some dentists provide inadequate treatment and advice or do not recognise when a referral to a specialist dental practitioner is needed. In such cases the Periodontal Disease remains active, threatening the future of a patient’s teeth.

Root canal treatment is a common dental procedure used to treat infection at the centre of a tooth with most of these procedures being successful. However, the dentists sometimes makes a mistake when performing a root canal treatment, which can lead to a patient continuing to suffer with pain, the treatment may have to be repeated or the tooth may need extracting.

Gum Disease

Root Canal Treatment negligence can take many different forms so if you feel that you have been the victim of this type of dental negligence contact us today.

Cosmetic dental procedures include veneers, orthodontics, bleaching, bridges, crowns, dental implants and the replacement of amalgam fillings. A failure by the dentist to properly assess the patient and their medical history before recommending treatment. This type of negligence results in unsuitable treatments being recommended and provided which can fail. This may lead to pain and suffering, the need to undergo further treatment and sometimes the loss of teeth.

The dentists sometimes can make mistakes and fail to recognise symptoms of oral cancer, incorrectly diagnose symptoms as being of another less serious condition or fail to undertake the necessary examinations.

A delay in the diagnosis of oral cancer can lead to further pain and suffering, less effective treatment, fewer treatment options and sadly, in the worst cases, reduced life expectancy and death.

Orthodontics provide treatment to improve the positioning of teeth. Whilst this procedure / treatment has become very popular with the introduction of key market leaders in “transform a smile”. Unfortunately, there are a growing number of claims where patients have not received the best possible care in the hands of the orthodontics, with negligence causing pain, suffering and injury.

If you have received unsuitable treatment and injury has been caused you may have a claim. A failure to properly assess a patient and carefully plan the treatment may lead to the patient receiving unsuitable treatment and injury being caused, including the loss of teeth.

With some forms of orthodontic treatment, teeth may need to be extracted to ease the overcrowding or to expose the adult teeth which are still within the gum. Unfortunately, negligence and/or poor planning can lead to the wrong tooth or teeth being extracted.

The extraction of wisdom teeth whilst one of the common procedures in the UK can unfortunately lead to errors and mistakes occurring during the procedure. Negligence can be caused by a failure to properly assess a patient before the extraction or by a dentist attempting the procedure who lacks the experience when in fact a referral to a specialist should have been made. This form of negligence may lead to a patient suffering from additional pain and the loss of feeling in the jaw, face and tongue.

The extraction of a Wisdom tooth may cause significant damage to the nerves in the face and jaw leading to suffering with symptoms, such as a loss of sensation, numbness, pins and needles, pain and the loss of taste which may provide grounds to make a dental negligence claim. Other common errors include the extraction causing damage to other teeth, bridges or crowns. Sometimes a serious fracture of the jaw bone can occur as a result of the excessive use of force during the extraction.

Dental implants are a surgical procedure and should be carefully planned and only carried out by a dental professional who has the necessary skills and expertise to carry out a dental implant procedure.

Some common mistakes, which are likely to provide grounds to make a claim include the dentist failing to properly assess the patient to ensure that they are suitable to receive a dental implant. Where a patient is not suitable for an implant, there is a high chance of the treatment failing, causing damage and injury. Other common mistakes include the implant is placed when a patient has insufficient bone in the gum or active gum disease causing the patient pain and suffering.

Bridges are used to replace a missing tooth or teeth and link to adjacent teeth. Some common mistakes by dentists with bridges, which may provide grounds to make a claim. The teeth supporting the bridge are inadequately assessed, leading to complications, and sometimes the loss of these teeth is another common mistake by the dentist or the bite is inadequately assessed, leading to discomfort and jaw pain for the patient.

If you have experienced any of the following you may be eligible to claim for general dental negligence:

  • Failure of fillings
  • Poor hygiene and infection control
  • Failure to detect and treat decay
  • Injury caused by a drill or other dental equipment

A dentist should carefully plan and properly assess the tooth to be removed and plan the procedure and exercise care when performing the extraction. A failure to do so may lead to a mistake and cause injury to the patient. Some common mistakes made by dentists, which are likely to provide grounds to make a dental negligence claim, are:

Tooth Extraction
  • The wrong tooth being extracted.
  • A serious fracture of the jaw bone is caused because the dentist has used excessive force.
  • Damage caused to a nerve because the dentist has failed to exercise proper care.
  • Damage to other teeth, bridges or crowns.
